UPDATE: Assemblyman Moriarty Arrested on DWI Charge; Legislator Denies Charge
The Fourth Legislative District assemblyman was arrested Tuesday in his hometown of Washington Township.

GLOUCESTER TOWNSHIP, NJ -- Several sources have confirmed Fourth Legislative District Assemblyman Paul D. Moriarty was arrested Tuesday afternoon on suspicion of driving while intoxicated.
Moriarty was arrested in his hometown of Washington Township, Gloucester County. He reportedly refused to provide a breath sample once at the police station, according to one source, who spoke to Patch on condition of anonymity due to the ongoing nature of the investigation.
Moriarty, 55, served as Washington Township mayor from 2004 through 2008. He was elected to the Assembly in 2005.
The four-term Assembly Democrat previously worked as an investigative reporter for CBS 3 in Philadelphia.
A voicemail left on Moriarty's cell phone Tuesday evening seeking comment was not immediately returned.
Washington Township Police would not confirm to Patch there was an arrest or charges filed against Moriarty.
"At this point, I'm not going to comment one way or the other," Capt. Richard Leonard responded when asked if Moriarty had been taken into police custody Tuesday.
Bernie Weisenfeld, a spokesman for the Gloucester County Prosecutor's Office, said Tuesday evening that he had no information regarding Moriarty's arrest, since the case is not being handled by his office.
The Fourth Legislative District is comprised of Chesilhurst, Clementon, Gloucester Township, Laurel Springs, Lindenwold and Winslow in Camden County; and Monroe, Pitman and Washington Township in Gloucester County.
UPDATE, 7/31 at 9:45 p.m.: Assemblyman Paul Moriarty issued the following statement by email:
This afternoon after spending over an hour at my local car dealership and heading to grab lunch, I was pulled over by a Washington Township Police Officer who claimed I had cut him off at an intersection. I disputed his assertion which led him to order me from my car, submit me to a field sobriety test and issue a summons for DUI. Let me be clear: I had consumed no alcoholic beverages, and this entire episode was an abuse of power.
The Officer that detained me, today, was previously fired from the Washington Township Police Department for allegedly being untruthful in an Internal Affairs Investigation. A court subsequently ordered his reinstatement.
My attorney intends to vigorously defend these allegations, which may include filing charges with Washington Township Police Department's Internal Affairs.

He has served in the state Assembly since 2006, and is currently chairman of the Consumer Affairs Committee.
Most recently, he sponsored a bill that would allow prosecutors to charge those driving while illegally using a cellphone with being reckless, meaning prosecutors can then file criminal charges, such as assault by auto or vehicular homicide, against them if they cause serious injury or death.
“We now have anecdotal evidence and more scientific studies that show that texting while driving is more dangerous than drinking while driving,” Moriarty told the Gloucester County Times when the bill, named after Washington Township resident Toni Bolis, was being heard in the State House. “It seems to me that we have to evolve here and recognize that this is much more dangerous.”

Unfortunately as a law maker in this State, he threw himself under the bus. Refusal results in automatic guilty charge with lost of license for first offensive up to seven months in most cases. Point is,we should expect better out of the people who we trust to make our State Laws.

Thats just my point Linda he has done fine with his job as a Assembly Man, but made a mistake. The laws on drinking and driving are so strict now if you have one beer with certain licenses you are considered drunk.

OK, lets have an ammendment to the refusal to take a sobriety test when pulled over, from now on everybody gets one "get out of jail free " card. After all it was Just a "harmless mistake" you know.... What a dopey remark.

If he was a Republicans, the big story and draw attention from all over the state with outcry coming that he should resign. He is a Democrat so he'll make an apology, claim his parents were alcoholics and by next week it'll be a short term memory. Different rules for different people.

He stated that he had not been drinking. I tend to believe him. This has nothing to do with politics, but everything to do with the abuse of power that the police officers in Gloucester, Winslow, and Washington Township tend to exhibit, usually upon our African American young men. This just goes to show no one is exempt from their bullying.

The bottom line is; if you have not been drinking, then you should not have a problem submitting breath samples. The newer breathalyzer machines cannot be manually altered by the officer! Actually, the alcotest machine (breathalyzer) gives you an immediate printout of what you blow...and like anything else, the assemblymen has the right to an immediate blood test! So if you have nothing to hide, you should cooperate with the police.. And if the police are wrong, take your action against them. The assemblyman should save his money, and simply learn to follow directions

It's his right to refuse it and the point is why should he have to when he has do thing wrong. If he had succumbed to the breajthalyzer then who knows how that would have been abused. When the school bully says give me your lunch and every day you do that's enabling. On the one day you don't give in and get beat up do you say oh why didn't you just give him your lunch? Sorry, Anderson, but your logic does not fly. If you have nothing to hide then you should have no objection to the TSA reaching down your pants at the airport, right? Neither should you object to your infant's or incontinent grandparent's diaper being inspected or your elderly uncle's colostomy bag being fiddled with. Nor should you object to your wife or your daughter being forced to drink their own breast milk.
At what point do our freedoms kick in? Do I have any right to be left alone without having to answer to any and every spurious charge made against me? Do I have to prove myself innocent or am I innocent until proven guilty?
There is such a thing as an abuse of power and if Mr. Moriarty is to be believed in this instance, he appears to have been a target. That's not too hard to believe.
So, guilty or not, if you are pulled over and subjected to a field sobriety test and fail, in the opinion of the issuing officer, and you get hauled in to have a breathalyzer test at the station, what happens to your automobile? If you pass the breathalyzer test, then what? Where's your car? I believe your vehicle has already been towed so who pays for towing and storage?

Paul you are correct. But the law that has screwed so many over cannot be changed unless done properly. Ignorance is no excuse No Breatalyzer equals GUILT. Maybe Mr Moriarty will have a new battle he can fight for the common man, oh and yes I did the same thing long ago and refused, feeling I was being unjustly accused by the officer. He smiled and said no problem. BIG PROBLEM!!! My lawyer arrived and said you blew it, if you took it we walk now you are screwed. Crappy law but hey aren't most of them.

So right. I left that crap hole 33 years ago and returned south. My family was originally from Bergen County. My wife wanted to move back there to Gloucester County. NO way! I own guns and I would have to give up all of them with the NAZI sherrifs they have there. I remember one case where an East Windsor Township sherrif would issue a permit. The guy sued and got it. Another guy arrested while moving to a new house. Christie pardoned him. And the guy who's plane had to land in Newark and not Philly and was arrested for tramsporting guns into the state. What a sorry place to be.

Go Mariarty Go! I hope he fights this as aggressively and publicly as possible. Now, ROB ANDREWS' integrity is being questioned? ROB ANDREWS'?????
